
LEGAL NOTICE
In order to comply with Spanish Law 34/2002 of 11 July on Information Society Services and Electronic Commerce, and in particular Article 10 thereof, the following legal notice (the “Legal Notice”) is made available to the user.
Access to, browsing and use of the websites
(the “Website” or the “Platform”) imply tacit and unreserved acceptance of all the provisions of this Legal Notice, with the same validity and effect as any contract executed in writing and signed.
Its observance and compliance shall be required of any person who accesses, browses or uses the Platform (the “User” or the “Users”). If you do not agree with the conditions set out herein, please do not access, browse or use the Platform.

PURPOSE
This legal notice governs access to, browsing and use of the Platform, through which we inform Users of their rights and obligations regarding the content displayed thereon, the logos and trademarks used, and the liability that may arise from their use.
Access to the Website is free of charge, save for the cost of connection through the telecommunications network supplied by the access provider engaged by the Users. The purpose of the Platform is principally to present EUROMANDALA GROUP S.L. and to provide access to its Services.
Notwithstanding the foregoing, Euromandala reserves the right to modify the presentation, configuration and content of the Platform, as well as this Legal Notice, and Users are therefore advised to review them periodically. Access to and/or use of the Platform after such modifications or changes have taken effect shall constitute acceptance thereof.
INTELLECTUAL AND INDUSTRIAL PROPERTY RIGHTS
The User acknowledges and accepts that Euromandala is the exclusive owner of the intellectual property, industrial property and any other rights relating to the Platform. This includes, without limitation, the rights of reproduction, distribution, public communication, making available and transformation of the Platform and any of its elements, including source code, object code, technical documentation, user manuals, etc., as well as any other related or derivative element.
Acceptance of this Legal Notice shall not be understood as granting the User any intellectual or industrial property right, or any other right, relating to the Platform, beyond the right of use under the terms set out herein.
In accordance with the foregoing, the User undertakes not to:
Duplicate, reproduce, sell, rent, lease, license, distribute or otherwise use the Platform software for any purpose other than that expressly authorised in these Terms;
Decompile, modify, reformat, translate, reverse engineer, disassemble or otherwise access the source code of the Platform software, without prejudice to the cases in which applicable law expressly permits such activities regardless of any contrary agreement or authorisation with the User;
Divide or fragment the Platform into different parts or modules in order to use them independently;
Alter or remove any notices relating to intellectual property, industrial property or any other rights included in the software;
Infringe the intellectual property, industrial property or any other rights that Euromandala holds over the Platform;
Develop computer programs, applications or other IT products that perform a function similar to the private area of the Platform, where such development is based on intellectual property assets owned by Euromandala or on knowledge acquired as a consequence of the contractual relationship with the User;
Register trademarks, trade names or any other distinctive sign associated, or that could be associated, with the Platform.
In order to enable Euromandala to effectively monitor and defend its intellectual property rights, Euromandala may collect information and any other data relevant to verifying the actual use of the Platform.
Accordingly, Euromandala is entitled to use the information collected during the use of the Platform as effective evidence of such use in any proceedings of any nature, whether against the User itself or against any third party.
Euromandala is the owner or, where applicable, holds the corresponding licences over the intellectual, industrial, image and any other analogous rights relating to the Platform, as well as all content offered therein, including, by way of example and without limitation, photographs, illustrations, logos, trademarks, graphics, designs, interfaces or any other information or content included therein.
Users have only a non-exclusive right of use, strictly within the personal sphere and for the sole purpose of browsing the Platform in accordance with this Legal Notice.
PLATFORM USAGE RULES
Access to or use of the Platform for unlawful or unauthorised purposes, with or without economic intent, is not permitted, and the consequences thereof shall be the sole responsibility of the Users. In particular, and without limitation, the following is prohibited:
using the Platform in any way that may cause damage, interruptions, inefficiencies or defects in its operation or in third-party devices;
using the Platform to transmit, install or publish any virus, Trojan, worm, malicious code or other harmful programs or files or files with unlawful intent;
using the Platform to transmit advertising or promotional material, including spam, chain e-mails or similar, without the prior express written authorisation of Euromandala;
using the Platform in a manner that constitutes an infringement of any rights of Euromandala or of third parties;
using the Platform to transmit or publish any defamatory, offensive, racist, vulgar, degrading, pornographic, obscene or threatening material, or material that may disturb, harm or merely affect any person at Euromandala's discretion;
using the Platform to collect personal data of other users;
using the Platform unlawfully, contrary to good faith, morality and/or public order;
accessing without authorisation any section of the Platform, any systems or networks connected thereto, any Euromandala server or the services offered through the Platform by means of hacking or forgery, password extraction or any other illegitimate means or means set out in this legal notice;
carrying out any action that causes a disproportionate or unnecessary saturation of the Platform's infrastructure or of the systems or networks used by, or owned by, Euromandala, as well as of the systems and networks connected to the Website.
Breach of any of the foregoing obligations by Users of the Platform may lead Euromandala to adopt such measures as are appropriate under the law and in the exercise of its legitimate interests.
All information provided by the User through the Platform's forms for the above or any other purposes must be truthful. To this end, the User warrants the authenticity of all data communicated and shall keep the information provided to Euromandala fully up to date so that it reflects, at all times, the User's actual situation. In any event, the User shall be solely responsible for any false or inaccurate statements made and for the damage caused to Euromandala or third parties as a result of the information provided.
LIABILITIES AND WARRANTIES
Euromandala cannot guarantee the reliability, usefulness or accuracy of all the information contained on the Platform, nor the usefulness or accuracy of the content made available to Users through it.
Consequently, Euromandala does not warrant and is not liable for:
the continuity of the Platform's content;
the absence of errors in such content;
the absence of viruses, Trojans, worms and/or other malicious or technologically harmful components in the Platform or in the server that supplies them;
the invulnerability of the Platform and/or the impossibility of breaching the security measures adopted therein;
any lack of usefulness or performance of the Platform's content;
Platform failures caused by any kind of attack on its servers or on those of Euromandala's third-party service providers, as well as technical or security failures of any such providers that prevent the proper functioning of the Platform;
any technical failure, of any kind, that hinders, delays or prevents the proper functioning of the Platform;
the damage caused, to themselves or to a third party, by any person who breaches the conditions, rules and instructions that Euromandala establishes on the Platform or who breaches the security systems.
Euromandala declares that it has adopted all measures necessary, within its capabilities and the state of the art, to ensure the functioning of the Platform and to minimise system errors, both from a technical standpoint and as regards the content published on the Platform.
Euromandala shall not be liable for the accuracy, completeness or up-to-dateness of information published on the Platform that comes from external sources, nor for that contained on other platforms linked from the Platform.
Euromandala reserves the right to suspend, modify, restrict or interrupt, whether temporarily or permanently, access to, browsing of, use, hosting and/or downloading of the content and/or use of services of the Platform, with or without prior notice, with respect to Users who breach any of the provisions set out in this legal notice, without any right to claim compensation arising therefrom.
FORCE MAJEURE
Notwithstanding the foregoing, Euromandala shall not be liable for any delays or failures in the access, operation and functionality of the Platform, its content and/or services, nor for interruptions, suspensions or malfunctions thereof, where these arise from breakdowns caused by any situation of force majeure or fortuitous event.
Likewise, Euromandala shall not be liable for any failure or delay in performing any action where it is due to events beyond reasonable control (a “Force Majeure Event”).
Force Majeure Events shall include any act, event, failure to act, omission or accident beyond our reasonable control, including but not limited to the following:
Strikes, lockouts or other industrial action;
Civil unrest, riot, invasion, terrorist threat or attack, war (whether declared or not) or threat or preparations for war;
Fire, explosion, storm, flood, earthquake, subsidence, epidemic or any other natural disaster;
Inability to use trains, ships, aircraft, motor transport or other means of transport, whether public or private;
Inability to use public or private telecommunications systems;
Acts, decrees, legislation, regulations or restrictions of any government or public authority.
Such actions shall be deemed suspended for the period during which the Force Majeure Event continues, and Euromandala shall be granted an extension of time to perform them equal to the duration of the Force Majeure Event. Euromandala shall use all reasonable means to bring the Force Majeure Event to an end or to find a solution that enables it to perform its obligations despite the Force Majeure Event.
CUSTOMER SUPPORT
Users have at their disposal the customer support service through which Euromandala will handle enquiries, complaints and suggestions raised by them.

Euromandala will respond to complaints or enquiries as soon as possible and, in any event, within a maximum period of one (1) month from the submission of the complaint.
If the trader has not satisfactorily resolved a complaint submitted directly to it by a consumer, the consumer may turn to an alternative dispute resolution entity notified to the European Commission, in accordance with Spanish Law 7/2017 transposing into Spanish law Directive 2013/11/EU of the European Parliament and of the Council of 21 May 2013 on alternative dispute resolution for consumer disputes.

PROTECTION OF PERSONAL DATA
In accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (the “GDPR”), and Spanish Organic Law 3/2018 of 5 December on Personal Data Protection and Guarantee of Digital Rights (the “LOPDGDD”), all personal data provided during the use of the Platform will be processed in accordance with the Privacy Policy which Users must read and, where applicable, accept and/or consent to.
SEVERABILITY CLAUSE
All clauses or provisions of this Legal Notice shall be construed independently, and the remaining clauses shall not be affected if any of them is declared null and void by a final court judgment or arbitral award. The affected clause or clauses shall be replaced by another or others that preserve the effects pursued by this Legal Notice.
GOVERNING LAW AND JURISDICTION
Access to and use of the Platform shall be governed by and construed in accordance with Spanish law.
Should any conflict or discrepancy arise in the interpretation and/or application of the legal notice, the competent courts shall be those determined by the applicable legal framework and, where permitted, all disputes shall be submitted to the Courts and Tribunals of the city of Madrid.
